This Privacy Policy describes how 1PercentKind ("we," "our," or "us"), provided by 1PercentKind LLC, an Ohio limited liability company with its principal place of business in the United States, collects, uses, discloses, and safeguards your information. We operate the 1PercentKind mobile application and related services (the "Platform" or "Service"), a social connection platform designed to reduce senior loneliness by matching older adults with vetted younger volunteers.
Because we are a U.S.-based entity, we do not currently maintain an establishment in the European Union and have not designated an EU representative because Article 27 GDPR does not currently apply to our operations.
Please read this Privacy Policy carefully. If you do not agree with the terms of this privacy policy, please do not access the application. Your use of the Platform is also governed by our Terms of Service, which includes provisions on user safety, volunteer vetting, caregiver relationships, our healthcare disclaimer, and mandatory dispute resolution provisions.
We collect information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("Personal Information"). We apply data minimization principles and only collect information reasonably necessary to provide the Service.

Note on Calls: The 1PercentKind Minimum Viable Product (MVP) app facilitates connections by launching your device's native phone dialer or opening Google Meet links. At the time of this policy, we do not record, transcribe, or listen to your calls.

To ensure the safety of our community, independent Volunteers are subject to background checks.
These checks are performed by our third-party partner, Checkr, which acts as an independent consumer reporting agency under the Fair Credit Reporting Act (FCRA). 1PercentKind is not a Consumer Reporting Agency. Employment decisions are not made using these reports because Volunteers are not employees of 1PercentKind.
Background check data is collected directly by Checkr under separate consent disclosures provided during the Volunteer onboarding flow. 1PercentKind only receives authorization statuses (e.g., "Clear" or "Consider") from Checkr. We do not receive or store raw background reports, Social Security Numbers (SSNs), or raw criminal records. Checkr's collection and processing of your information is governed by its own privacy practices and applicable law.
We use industry-standard administrative, technical, and organizational safeguards to help protect your Personal Information from unauthorized access, loss, misuse, or alteration. These practices include encryption in transit (TLS) for all data transmitted between the application and our servers, encryption at rest, least privilege access, and periodic security reviews.
Although we use reasonable safeguards, no method of transmission or electronic storage is completely secure. We cannot guarantee absolute security.

How to Exercise Your Rights: Contact us at privacy@1percentkind.com. We respond within applicable legal deadlines, including 45 days where required under U.S. law and one month where required under the GDPR. We may request information sufficient to verify your identity before processing requests. You may also use an authorized agent to submit a request on your behalf, provided the agent supplies valid written authorization.
You have control over your data on the Platform:
If a Senior user wishes to utilize the Family Caregiver feature, the Senior or their legally authorized representative must authorize the creation of the caregiver link.
By creating or managing a profile on behalf of a Senior, the Family Caregiver represents and warrants that they possess the proper legal authority (e.g., Power of Attorney, legal guardianship, or express documented consent) to handle the Senior's Personal Information. We may require documentation demonstrating this legal authority.
Caregivers can view aggregate activity, but they cannot edit the Senior's profile, terminate matches, or access communication contents. The Senior or their authorized representative retains ownership of the account and may revoke caregiver permissions or request account deletion at any time.
Our Service is not directed to children. To use the Platform:
We do not knowingly allow anyone under 18 to create an account. If we become aware that we have collected Personal Information from an underage individual, we will take steps to remove that information.
1PercentKind operates in the United States. Your information may be transferred to, stored, and processed in the United States or other countries where our service providers maintain facilities. Where required by law, we rely on appropriate safeguards, contractual protections (such as Standard Contractual Clauses where applicable), or your consent for international transfers.
1PercentKind is a social connection platform, not a healthcare provider. We do not provide medical advice, diagnosis, treatment, or clinical services. Our Service is intended solely to foster social connections and reduce isolation.
Although users may voluntarily discuss health matters during conversations, 1PercentKind does not intentionally collect or process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). Furthermore, we do not intentionally collect "Consumer Health Data" as defined by state health privacy laws (such as Washington's My Health My Data Act, Nevada SB 370, the Connecticut Data Privacy Act, or New York health privacy laws), and California CMIA generally does not apply as we are not a healthcare provider.
If users voluntarily disclose medical information during calls, 1PercentKind does not monitor, record, or store those conversations.
Users should avoid sharing sensitive personal information (such as Social Security numbers, financial account numbers, passwords, or medical records) during calls or in profile fields. We explicitly instruct users not to submit sensitive medical or diagnosis information through free-text fields, interest preferences, or any other medium within the Platform.
1PercentKind facilitates connections by launching the native phone dialer or Google Meet. We do not record, transcribe, monitor, or listen to user conversations. As outlined in our Terms of Service, users are strictly prohibited from recording, transcribing, or capturing screenshots/video of any calls without the explicit prior consent of all participants.
